When one gives careful consideration to the provisions of the 5th Amendment to the U.S. Constitution, it becomes clear that Obama and company have committed impeachable offenses in the government-imposed and supervised bankruptcy terms for GM and Chrysler.
Obama has violated the provisions of the 5th Amendment in at least 2 places--the due process clause and the just compensation clause.

Follow-Up to 'Don't Tread on Me' Controversy
It seems that the veracity of the story about the man in Louisiana who was detained by law enforcement due to his bumper-sticker that says 'Don't Tread on Me' is in dispute.
As a follow-up I noticed that World Net Daily has a major, exclusive story on this matter.
The WND reporter contacted the persons involved in Ball, Louisiana, and spoke directly with the person detained by police and his sister-in-law. Their names are being withheld by WND.
Contrary to the opinion of some, I have not found WND to be untrustworthy. I do admit they publish stories that sometimes can be hard to verify due to the extreme sensitive nature of their content...and the fact that you won't find these types of stories reported by anyone else.
And this is why I see their value.
On the other hand, Texas Fred is a blogger that I trust. He says that the story is not true.
Here is Fred's reasoning:
I have absolutely no reason to doubt or question Fred's integrity as he has been a stellar example of honesty in the time I have known him.
But I do believe there is more to this story than what meets the eye. It may not have been Ball police officers that pulled him over. It could have been any number of law enforcement agencies--county, state, etc.
I am also certain that they would not pull him over for merely displaying the bumper sticker, although that may have been an unspoken, underlying reason for doing so. They are not going to subject themselves to legal and disciplinary action, but cops use all sorts of legitimate excuses to pull over drivers, when their ulterior motive is something different.
We also must not forget that the Obama administration sent out a memo to all law enforcement agencies in the country alerting them to the now-infamous 'potential homegrown terrorist' allegation directed at patriotic Americans.
One thing is for certain, if the story turns out to be false, I WILL retract it. Until we get clear proof, stay tuned...

Something about this story stinks man, not your part, you're reporting from the source, I am going on experience, and the fact that I am from Louisiana, it's my home, and the fact that our entire family, both sides, mine and the wife, are cops, past, present and retired, and the Louisiana branch have ALL called BS on this one...

Bill Quietly Becomes Law That Forbids Opposition! (UPDATE)

Americans 'Scared' of the Words of the Framers?
It would appear that many Americans today are 'scared' of the direct words of the Framers of the U.S. Constitution.
Why would this be?

Bill to Control Religious Group Fails!
Under intense pressure from concerned citizens, Connecticut Democrats withdrew their bill to control the Roman Catholic Church in the state.

What If 'Direct Orders' Go Against Constitution?
Increasingly in today's Topsy-turvy world, military and police officials are finding themselves facing a critical issue that goes to heart of the American way of life--'What should I do when a direct order requires me to go against the Constitution?'
One group in particular, Oath Keepers, is determined to uphold the Constitution even if it means disobeying orders.

Guns A-Blazin'
Let's cut right to the chase at the very outset. The Founders of this Republic believed that all citizens should be armed as the best means of preventing government tyranny, including our own. They also believed that the rights enumerated in the First Amendment were secured and protected by an armed citizenry.
Now that we have that much out of the way, let's move on to another step.
Since the Founders believed these things and included gun rights in the Bill of Rights to be protected as one of the 'unalienable rights' of citizens, all of our so-called 'reasonable restrictions' on gun rights are illegal.
The common argument, for example, in favor of gun control compares firearms registration with getting a driver's license. But the two cannot be compared because getting a driver's license is not a Constitutional right but a privilege granted by states. Keeping and bearing firearms is not a privilege granted by anyone. It is an absolute right as stated in the Constitution.
OK, so we have dropped the ball in allowing encroachments upon this unalienable right ever since the 1940s. We refused to mount a serious fight against gun control in all forms. We did not draw a line in the sand, and even if we did, we didn't force those who crossed that line to suffer any measurable consequence.
That day is quickly drawing to an end.
Citizens around this nation who are perceptive and aware enough to know that under the current administration and Congress our rights are in grave danger are beginning to wake up to the fact that a day of reckoning may be approaching.
And, as the 'run on the gun shops' is proving, the citizens in record numbers are getting prepared not only to draw a line in the sand but to force those who cross that line to pay for their actions.
Never again will we allow the forces of anti-freedom in this country to encroach upon a God-given, Constitution-protected right. We have learned our lesson from our failures of the past. And we are ready.

MORE OUTRAGE! THIS TIME, IT'S GUN RIGHTS!
By now it should be very clear to any thinking person who values liberty that Obama, together with a Democrat Congress, is a scourge to the nation. But it only gets worse.
A U.S. Court of Appeals, 2nd Circuit, has ruled that the Second Amendment cannot override gun bans imposed by individual states.
The notion is an outrage by the mere fact that there is no need for any 'Bill of Rights' at all if those rights do not apply to the citizens of the country in all of the individual states.
Thus, if you live in a state that bans all handguns, for example, then you are thoroughly screwed because the right of your state to take away your rights overrides any provision in the U.S. Constitution that protects those rights.
What complete, lawless, subversive, and dangerous imbeciles we have sitting on Court benches in America!
This quotation from Western Rifle Shooters Association says it all:

'The Unwritten Constitution'
Certain unwritten but commonly accepted truths undergird the U.S. Constitution. These concepts are known as 'the unwritten Constitution,' and are often cited in the writings of the Founding Fathers.
Constitutional truth is in no way as complicated a matter as the legal profession would have us believe.
The Founding Fathers did us all a great favor by leaving behind their written works for us to see. And within those documents we find the commonly accepted truths that led them to frame the Constitution in the manner in which they did.
For example, the First Amendment provision of freedom of religion was never meant to keep religion out of the public marketplace of ideas but to prevent government from establishing an official church of the United States, supported with our tax dollars such as we find in Great Britain and dozens of other countries.
In like manner, we know that the Second Amendment provision of the freedom to keep and bear arms is an individual right and not a collective one.

Mike Vanderboegh has written a most interesting piece on the topic of 'the unwritten Constitution' that begs for these issues to be discussed and considered by all of those who are serious students of the U.S. Constitution and the Bill of Rights.
I strongly urge each of you to carefully read it and contemplate the obvious issues that arise from it.

Bill of Rights Day--An American Benchmark
This is a Liberty Sphere classic from 2006--one of my first posts after launching this blog. It is entitled, 'An Ignored American Benchmark--Dec. 15.'
On December 15 we mark one of the most important dates in American history, yet it is one with which I am sure many of you may not be familiar. The 'Bill of Rights Day' is celebrated on December 15, and the fact that this date in history is one of the most unnoticed and ignored speaks volumes about the U.S. educational system.
Since 1941 the ratification of the Bill of Rights has been commemorated in this country on December 15. Yet today, I am sure that the average guy on the street has no clue that one of the most significant events in human history happened on that day...thanks to the dumbing down of the educational system and the failure of modern politicians to give proper recognition to the basic rights we all are guaranteed in the United States of America.
The original Constitution, ratified in 1788, had no Bill of Rights. The fledgling young Republic had just managed to fight off the British for their independence and declare themselves a new nation united by a commonly accepted rule of law--the U.S. Constitution. Yet long before the Constitution was ratified many of the Founders insisted that the document would be woefully incomplete without protecting certain individual rights. One of these was James Madison, who was elected by Virginia to the first Congress upon the promise that he would work for a Bill of Rights.
George Mason, also of Virginia, refused to sign the original Constitution precisely because it contained no Bill of Rights. Mason had written a Bill of Rights for the state of Virginia which many other states used to adopt their own Bill of Rights.
Patrick Henry had originally opposed the inclusion of the Bill. Revisionist historians often use Henry as some sort of proof that the Founders were not in agreement about the rights that should be guaranteed to the citizens. Nothing could be further from the truth. Henry also opposed the Constitution. But this was not due to anything other than his opposition to a centralized government of any kind, believing instead that such power should be reserved for the states.
It is also to be noted that in spite of Patrick Henry's initial opposition, he would later change his mind and work for both the U.S. Constitution and for the ratification of the Bill of Rights.
Having succeeded in getting a Constitution approved by the states, the Founders went to work on a document that would protect the rights with which each citizen had been endowed by their Creator. The Bill does not 'grant' or 'give' rights. The rights are automatically inherent in our very existence. The Constitution PROTECTS these basic, inherent rights.
In 1789 the Bill of Rights was written in Federal Hall in New York City, which at the time was the capital of the U.S. The first Congress was made up of 26 Senators and 65 Representatives from the 13 states. On September 25, 1789, Congress passed 12 amendments to the Constitution which would be called the Bill of Rights. In October of that year President George Washington sent a copy of the 12 amendments to the states for their approval.
From October of 1789 until December of 1791 the thirteen states debated the amendments. By the time the amendments had made their rounds the original 12 amendments were whittled down to 10. On December 15, 1791, Virginia became the eleventh state to ratify the 10 amendments, and thus, according to the provisions of amending the Constitution, the Bill of Rights became part of the supreme law of the land.
During these days when collectivist revisionists see no inherent individual rights in the Bill of RIGHTS, it is vitally important to note that the sole motivation of the Founders in insisting on the Bill was the protection of INDIVIDUAL rights. It is impossible, for example, for someone to make a valid philosophical argument claiming that the 2nd Amendment does nothing but establish a militia, when the whole idea of the Bill to begin with was to protect the INDIVIDUAL rights of citizens.
Thus, on this December 15 let each of us as Americans give thought to the basic philosophical premise that motivated the Founders--that each individual American is free, and as such, we are guaranteed the protection of certain specified individual rights. If no such guarantee exists, then the whole notion of establishing a free Republic was in vain.

From October of 1789 until December of 1791 the thirteen states debated the amendments. By the time the amendments had made their rounds the original 12 amendments were whittled down to 10. On December 15, 1791, Virginia became the eleventh state to ratify the 10 amendments, and thus, according to the provisions of amending the Constitution, the Bill of Rights became part of the supreme law of the land.
During these days when collectivist revisionists see no inherent individual rights in the Bill of RIGHTS, it is vitally important to note that the sole motivation of the Founders in insisting on the Bill was the protection of INDIVIDUAL rights. It is impossible, for example, for someone to make a valid philosophical argument claiming that the 2nd Amendment does nothing but establish a militia, when the whole idea of the Bill to begin with was to protect the INDIVIDUAL rights of citizens.
Thus, on this December 15 let each of us as Americans give thought to the basic philosophical premise that motivated the Founders--that each individual American is free, and as such, we are guaranteed the protection of certain specified individual rights. If no such guarantee exists, then the whole notion of establishing a free Republic was in vain.

Wisdom for the Storms Ahead
A statement of advice is found in The Bible which says, 'Be wise as a serpent and harmless as a dove.'
Very good advice, it would seem, for those who would act and behave with wisdom.
Wisdom is not in knowing that you have the power to act but in knowing when and how to act.
As we face great uncertainty in the coming days with regard to the Constitutional protections of our God-given rights, the issue it seems is not allowing ourselves to react in knee-jerk fashion to every single perceived threat to liberty.
The key issue is to act, not react, in response to actual, verified threats to our safety, our right to self-defense, our right to live peacefully in freedom.
The way of the Timothy McVeigh phenomenon is NOT our way. We want absolutely no harm to come to anyone, except in the case of clear self-defense.
On the other hand, when it comes to defending the Constitution, the Bill of Rights, the lives of those we love, and our own lives, we will use the resources and tools the Founding Fathers used to procure and guard liberty.

Calm, Rational Thoughts from the Non-Compliant
Make no mistake about it, many patriotic Americans have no intention of being compliant with laws, directives, and programs initiated during a possible Barack Obama administration.
This is no knee-jerk reaction, no hot-headed racist blather from hayseeds, no irrational musings from the paranoid, but the logical sequence of behaviors by those who still believe in the idea of liberty as encapsulated by the Founders in the U.S. Constitution.
And, since I have been designated as part of the 'angry mob against Obama,' I thought it would be appropriate to verbalize some of my calm, rational thoughts from the non-compliant sector of society.
First, let it be made crystal clear that tens of thousands, if not millions of Americans will be so thoroughly disgusted by the fact that an outright neo-Communist was elected to the White House that civil disobedience will become commonplace.
In the past, this action seemed to be reserved for those liberals who wished to overthrow the capitalism inherent in the U.S. Government. Today, however, civil disobedience will be embraced by those who love personal, individual liberty so much that they will dare to refuse to comply with the neo-Communist concepts espoused by Barack Obama and his supporters in Congress.
Two, some of these among the non-compliant may well refuse to pay taxes in protest, including some small business owners. Those who feel they cannot follow this course of action should not be singled out as 'turncoats,' for this decision is an ominous one that could land such persons in jail. This is a very personal decision made only after counting the cost soberly.
But even if we feel we cannot engage in this form of civil disobedience, we must lend our support in any way we can to those who put their all on the line in defense of liberty. This is a MUST.
Beyond these two principles, here is a list of some things ALL of us can do to express our outrage in the event that Obama is elected or the Democrats increase their majorities in the Congress, or both:
1. On Inauguration Day and afterward, we can inundate the White House and the offices of our Senators and Representatives with phone calls expressing our intent to oppose each and every proposal put forth by Barack Obama or a veto-proof liberal Congress. This tactic must be a permanent fact of everyday life and not just short term. We must keep the pressure on them each and every single day.
2. We can write letters on a regular basis to Senators, Governors, Representatives, and other government officials expressing our opposition to the Obama agenda. This, too, must be a regular, permanent tactic.
3. We can inundate newspapers with letters to the editor expressing opposition to Obama proposals...refraining from attacking but stating clearly and rationally why we oppose those proposals.
4. We can get involved with local politics, from the ground up, if we have not done so already. Lethargy on the part of mainstream America may be the very thing that ruins this country. We are about to lose our liberties. Our inaction will be partly to blame. We MUST change that now.
5. Between now and Inauguration Day purchase your tools...as many as you can. This may be the last time you and I as free citizens can exercise our Second Amendment rights in this country by buying firearms. If money is an issue, remember that $300 can purchase all you need if you know where to look.
6. Absolutely, positively refuse to turn over personal guns in the event of confiscation. This is OUR property, not theirs.
7. Join a conservative religious group that is not a part of the National Council of Churches or the World Council of Churches. These 2 organizations are full of Marxists. Conservative religious groups have some of the most stalwart advocates for personal rights and liberties anywhere. And beyond that, the message you hear might do you good.
8. If you can, pull your children-grandchildren out of the public school system. Find a school that teaches the principles of liberty, or decide to homeschool. The public school system in this country will become nothing more than a tool in the hands of Barack Obama to indoctrinate young minds in the ways of extremists like Bill Ayers.
9. Get out of debt as fast as you can. Tear up credit cards. Do your transactions with cash. Withdraw funds from banks and put the money in your personal safe. You can even take this further if you wish, withdrawing investments and stashing the money yourself in your safe. Pay yourself first. There really is no better way to force government and the new monopolistic banking system to deal with our displeasure than to hit them in the pocket book.
10. Make a list of like-minded persons who believe in the Constitution, the vision of the Founders, and the Bill of Rights. Make sure they are registered to vote. Get them to the polls in the next election. Become a free taxi service for the elderly, the frail, the sick--anyone who is like-minded but who cannot get to the polls on their own.
In short, as soon as the Election is over on November 4, begin laying the groundwork for the Congressional elections in 2010 and the Presidential election in 2012. The nation will be wrecked to pieces by the crowd getting ready to come to power this year . We must be ready to step up and step in to clean up the mess in 2010 and 2012.

What Is An 'Anti-American?'
An anonymous poster in the comments section of this blog took me to task over referring to former Democratic Presidential candidates George McGovern, Michael Dukakis, and John Kerry, and the present candidate Barack Obama, as anti-American.
I stand by the charge.
Thus, what is the definition of an 'anti-American?'
An anti-American is one whose political ideology is diametrically opposite of that which is embodied in the Constitution of the United States.
The Constitution is our final authority in all matters of law and governance.
Thus, one cannot be for robbing citizens of their right to own, bear, and use firearms for defense and protection, and then claim to uphold the U.S. Constitution. The two are mutually exclusive.
One cannot promote measures that limit free speech, free exercise of religion, a free press, or the freedom to assemble, and claim to uphold the U.S. Constitution. The two are blatantly incongruent.
And it really doesn't matter how much time such persons may have spent in the military. Some have even gone to war. While that is admirable, such acts of service to one's country do not automatically make them pro-American if they turn around and trash the Constitution in their political beliefs.
This is why in the United States of America one can be a true patriot even if they never served in the official, government-sanctioned military. And serving in that military does not automatically make one a patriot.
It is all about beliefs, ideology, political philosophy.
And this is precisely why I will fight tooth and toenail against those who self-righteously claim to be 'patriots' who love their country but who nonetheless work to rob citizens of their Constitutional rights, condone the killing of unborn infants and even those who survive attempts to kill them (this is barbarism every bit as dangerous as the Nazis and Communists), and who in the name of religion seek to steal from ordinary citizens through taxation to pay for programs that government has no business implementing in a free society.
In short, I don't give a damn what your military service has been if your views are more in line with Fidel Castro, Joseph Stalin, and Karl Marx than with Thomas Jefferson, Benjamin Franklin, and Patrick Henry.
As the old saying goes, 'Just because a mouse gets into the cookie jar doesn't make him a cookie.'

The Tipping Point May Be Closer Than You Think
All it would take for America to lose its hard-fought liberties as embodied in the Bill of Rights as applied to ALL citizens is two terms of Barack Obama along with a Democrat majority in Congress.
In less than 8 years the U.S. would become like Canada, Great Britain, and other so-called 'free countries' in the West that have disarmed their citizens and thrown people in jail for speaking their minds...unless their speech is approved by the 'pc speech and thought police.'
Canada even has the Nazi-like silencing of free speech down to an art through so-called 'human rights tribunals' that really have nothing to do with protecting human rights but persecuting and prosecuting citizens who speak an unpopular message that 'offends' certain minority sectors of society.
This is the ugly, hidden truth of modern-day liberalism. In the name of supposedly 'being open and accepting of all' liberals would dismantle the rights of citizens to say anything at all that anyone, anywhere would find offensive--that is, if the offended parties happen to be Muslim, gay, Leftist, or environmentalist extremist.
But the rest of us can simply go to hell.
Hence, Nancy Pelosi wants to bring back 'the fairness doctrine' so that she can be unfair to conservatives in the name of fairness.
With a majority in both houses of Congress, and with Barack Obama in the White House, you can rest assured that the Democrats will not stop until Rush Limbaugh, Sean Hannity, Glenn Beck and others are forced off the air. The politically correct movement will have a field day with such lunacy as equating those who believe the global warming theory is faulty science with 'Holocaust deniers.'
And don't forget the gun issue. No matter what the Supreme Court decided on Heller, two terms of Obama with a Democratic Congress will not only change the makeup of the Court but insure that gun bans are brought back full force.
My friends, this is why we may be nearing 'the tipping point.' Those who believe in the Bill of Rights for each individual citizen must get ready. If the potential scenario I have portrayed becomes reality, then it will be time to invoke Jefferson's reset button.

Second Amendment News Roundup Special Edition 6/26/08
This is a special edition of the Second Amendment News Roundup.
The United States Supreme Court ruled today that Americans have the right to own and keep firearms--including handguns--in their homes. The ruling struck down a District of Columbia law banning handguns.
Writing for the majority, Justice Antonin Scalia stated that the record of history both before and after the ratification of the Second Amendment shows that individual citizens have the right to their preferred method of self-protection--the handgun.
The ruling also struck down D.C.'s requirement for safety locks or keeping the firearms disassembled.
The ruling does, however, leave intact many local regulations on the use of firearms.
Shockingly, the decision came with a 5-4 majority. In dissent were Stevens, Breyer, Ginsberg, and Souter, which shows that our precious right to self-defense in this country is a tenuous one.
In fact, the anti-freedom crowd is already attempting to spin the decision to its benefit...Nancy Pelosi being one of them, stating that 'D.C. still has the right to regulate handguns.'

The United States Supreme Court ruled today that Americans have the right to own and keep firearms--including handguns--in their homes. The ruling struck down a District of Columbia law banning handguns.
Writing for the majority, Justice Antonin Scalia stated that the record of history both before and after the ratification of the Second Amendment shows that individual citizens have the right to their preferred method of self-protection--the handgun.
The ruling also struck down D.C.'s requirement for safety locks or keeping the firearms disassembled.
The ruling does, however, leave intact many local regulations on the use of firearms.
Shockingly, the decision came with a 5-4 majority. In dissent were Stevens, Breyer, Ginsberg, and Souter, which shows that our precious right to self-defense in this country is a tenuous one.
In fact, the anti-freedom crowd is already attempting to spin the decision to its benefit...Nancy Pelosi being one of them, stating that 'D.C. still has the right to regulate handguns.'
Joining Justice Scalia in the majority were Alito, Roberts, Kennedy, and Thomas.

A Country on Skid Row
Since the 1930s the United States has been slouching toward addiction. It started as all addictions do, with a sip here and there, gradually increasing the level of consumption, until finally the victim is totally dominated and overwhelmed by the substance.
Many of these wind up on skid row, their brains fried and unable to function logically.
Physicians have a terms for this final phase of the addiction--organic brain syndrome. At this stage brain cells have died never again to be regenerated, leaving the victim with thought processes that have no basis in reality.
Of course I am not suggesting that the U.S. is being ruined by alcohol or drugs. Quite to the contrary. America is being ruined by its addiction to big government.
During the Great Depression President Franklin D. Roosevelt and a Democratic-controlled Congress decided this was the perfect opportunity to introduce big government solutions closely akin to socialism into the American experience.
Ever since that time Americans and the politicians they elect have gradually increased the consumption of big government solutions until now most of them feel as if they are going through withdrawal symptoms if the nanny state is not there to wipe every runny nose, nurse every stubbed toe, and fix every single thing in our lives that is not perfect.
But I maintain it's even worse than that. It would seem a majority (not a big majority, but a majority nonetheless) have reached the stage of organic brain syndrome and are sitting squarely on skid row due to their morbid addiction to big government.
Here are a few examples of the fact that our elected officials, and the people who put them into office, have taken leave of their rationality:
--Congress by overwhelming majorities in both Houses banned incandescent light bulbs, thinking, obviously, that this is a legitimate role of government in the United States of America. Senate Majority Leader Harry Reid even stated forthrightly that this sort of thing IS the role of government.
--Although the Constitution clearly states that the right of THE PEOPLE to keep and bear firearms is not to be infringed (which means that this right is to be totally unfettered or unrestricted), Congress has just passed more laws restricting certain citizens from owning firearms--WITH THE SUPPORT OF THE LARGEST PRO-GUN LOBBY IN THE NATION. And don't give me this 'party line' that the bill does nothing and that it is a 'good bill.' To the contrary, it restricts what is supposed to be an unrestricted right. The NRA sold out on this one, to its shame.
--We have millions of people supporting for President a woman who thinks that her 'vast experience' includes the time she spent as the wife of a President, or a first-term Senator who has less than 2 years in office claiming he has 'the experience necessary' to lead America on the world stage. And then we have on the GOP side 'big government conservatives' (an oxymoron) such as Huckabee, Giuliani, and Romney. The best candidates are virtually ignored.
--We have an ambulance-chaser lawyer (John Edwards) who does not believe owning a gun is a Constitutional right but says that having free healthcare and Internet access ARE Constitutional rights. The law school that trained this man should recall his diploma. Yet, like sheep headed for the slaughter, millions of Americans will walk like zombies into polling places to vote for this man.
I could very well go on and on with more examples, such as the indoctrination to which the government educational system subjects our young, the attempt of the Supreme Court to weaken private property rights in favor of local municipalities who collude with big business to take private property, the notion that provisions in the Bill of Rights are not individual rights but 'collective rights,' which is just a code word for Communistic thinking.
You tell me. Does this sound like a rational country to you? Is the majority engaging in logical thinking? Are they even aware that the final rule of law for this nation is the Constitution, no matter what ANY court--even the Supreme Court--says?
I don't think they are aware at all. It's organic brain syndrome.
